In a verdict that releases thousands of Indians from the fear of prosecution and legal discrimination, the Supreme Court struck down Section 377 as illegal and arbitrary. The law, formed in 1860, was repealed by a bench led by the Chief Justice of India, Dipak Misra and comprising of justices Fali Nariman, A M Khanwilkar, D Y Chandrachud and Indu Malhotra.

The act criminalised various sexual acts, especially those between members of the same gender.
