The nation’s insurmountable distress over the H-1B visa program of the United States got a temporary sigh of relief, as a senior US official on Thursday expressed the H-1B visa program under ‘review’ by the US President Donald Trump administration showed no ‘restrictions’ in place.

According to Manorama Online, the official indicated that over 70 percent H-1B visas have been issued to Indians over a span of the nine months. He also mentioned that a record 1.2 million visas of Indians were examined thoroughly by the US in 2016.

What is H-1B Visa?

The H-1B is a visa in the United States which comes under the purview of the Immigration and Nationality Act, section 101(a)(17)(H). It allows U.S. employers to employ foreign workers in speciality occupations.

If a worker of another nationality under the H-1B status quits or is dismissed from his/her employer, the worker must either apply for and be granted a change of status, find another employer (subject to an application for adjustment of status and change of visa), or leave the United States.

Current situation

H-1B visas and L1 visas (work permit) to Indians have been increasing each year by six percent each.

“The president (Donald Trump) spoke about the review. There are no restrictions, but it (H-1B) is under review,” he said.

Even though the issue may not be on priority in the upcoming Indo-US bilateral dialogue on consular relations, there’s a possibility of further discussion. Another agenda on priority is a discussion on revoking the Deferred Action for Childhood Arrival (DACA) program, which hit over 7,000 Indian-Americans.

The Deferred Action for Childhood Arrivals program, or DACA, has protected over 800,000 young adult unauthorised or illegal immigrants from deportation and allowed them to work legally since 2012.

Donald Trump signed an executive order this April to make the rules of issuing H-1B visa stricter stating it’s a move to prevent ‘visa abuses’.

India ranks fifth in the largest group of worldwide immigrant visa applicants after China, Philippines, Dominican Republic and Mexico.

Last year, the US processed over 88,000 student visa applications. It has over 1.6 lakh Indian students currently, the second highest number of international students, after China.
